ORDERS of materials from Burt & Company are construed to be definite contracts to purchase. Every legal effort to provide those materials to you will be made and reasons to the contrary will be provided to you. Cancelation is forbidden of orders for materials not normally stocked by Burt & Company and needing to be specially ordered by Burt & Company for the customer.
No approval or consignment purchases are accepted.
There is a minimum purchase requirement of $10.00.
$2.00 handling is charged when original orders total less than $10.00.
GUARANTEE
Materials are warranted to the limits supported by the publishers and transporters, and against errors in handling by our staff. Customer’s judgment of the feasibility of the materials after purchase is not the responsibility of Burt & Company and therefore is not covered. See Returns Policy below.
DISCOUNTS are offered to everyone. An initial order of 10 items is required to participate. Every item thereafter will receive a discount. Please see our Discount Schedule for details. Discounts and prices vary and may change on the whim of the publisher.
SHIPPING
Orders received by 3:00 p.m. New York time, Monday through Friday, will, in most cases, be shipped the same day.
The cost of shipping less than 20 items, when mailed or faxed, and of all orders placed by the telephone, is the responsibility of the purchaser, who has final choice of method.
Shipping prices are waived for the initial dispatch of any normally priced 20+ item order that is submitted in a form other than by telephone, that is being sent to postal addresses within the United States, and where no special handling is requested. "Free Shipping" parcels are delivered by USPS Media Mail and may be in transit for 1 to 3 weeks. Customers may opt to pay for faster delivery (UPS, Priority Mail).
A handling fee of $1.00 is invoiced on all shipments where shipping fees are not waived.
Shipping charges are determined by the weight of the parcel as they correspond to the published rate charts of the shipping companies. We use United Parcel Service ("UPS") most often within the contiguous 48 United States as it is the most secure mode of transport. Insurance is included in the fee. US Priority Mail is used to US destinations when deemed cheaper than UPS. When materials are light enough to warrant (i.e.: single sheet of music) or when time, distance and cost factors appear to be more favorable, 1st Class Mail is employed. Media Mail ("Parcel Post"), Priority Mail and Express Mail are also available. Insurance, at an additional cost of $3.00, must be requested at the time of order.
We will honor no claims for damaged or lost packages if insurance has not been purchased.
PAYMENTS
We prefer that our customers use bankcards. We get our money immediately, while they don’t need to pay until it’s convenient. However credit guarantees are required for all purchases. Individuals must have a valid bankcard number on file at the time of purchase. Institutions must have credit references available when requested. No COD orders or personal checks as prepayment are accepted.
BANKCARD (Visa, MasterCard, American Express, Discover): Merchandise is invoiced at our best applicable discounts. QUICK PAYMENT DISCOUNTS ARE AUTOMATICALLY APPLIED.
30-DAY ACCOUNTS: Merchandise is invoiced at 5% less than our best discount. We will allow a 5% quick-payment discount for customers whose drafts are mailed within 5 days of merchandise delivery. Statements of accounts are issued on the 20th of each month.
(Personal): Bankcard required as credit security. Your Bankcard will be charged for the outstanding invoice plus .083% per day penalty on the date of printing of the 2nd statement after the original invoice date and the invoice will be declared paid (we’d rather the bank held the debt instead of us…we need the money!).
(Institutions): Statement of account are issued on the 20th of the month. Interest of .083% per day is charged on invoices open longer than 30 days.
$15.00 service charge is invoiced for returned checks.
BACKORDERS
All out-of-stocks will be backordered for you unless you specifically request us not to. Students and General Clientele: We ship your left-over backordered/special ordered music when the list is finally completed, unless you call to tell us otherwise. We charge you USPS Media Mail fees for this shipment, which starts at $3.41 for the first pound of music. Teachers, Schools, Churches: We write you to ask if you would like your left-over back-/special- ordered music sent immediately, paying whatever shipping costs that involves, held until you have more music to order that we can piggy-back this backorder with, or put back into general stock, since you and your students have no need for it any longer. Backorders for sporadic customers (those who visit every 90 days or longer) are shipped with no notice when the list is complete.
RETURNS
No returns are allowed for any reason if the date of request is greater than 30 days from date of purchase.
Only defective materials or errors by the publishers or by Burt & Company will be accepted for return.

Written authorization for returns of any materials is required.
We will pay the postage for the return of all materials where Burt & Company, the publisher or the transporter (when insured) has caused an error.
Materials received in our warehouse that do not meet these criteria and that we deem to be re-salable will be bought back from you at 80% of the price paid. All other material will be returned to the sender by uninsured Media Mail.
